Review of Application and Notice to Candidates. [Tex. Election Code Sec. 141.032]

  1. On the filing of an application for a place on the ballot, the authority with whom the application is filed must review the application to determine whether it complies with the requirements as to form, content, and procedure only. That is, the authority checks to be sure it was filed correctly and in a timely manner and that all required information is completed and attested to. [Sec. 141.032(a)] 

  2. Unless accompanied by a petition, the review must be completed not later than the fifth day after the date the application is received by the authority. [Sec. 141.032(b)] 

  3. If an application is accompanied by a petition, the petition is considered part of the application, and the review must be completed as soon as practicable after the date the application is received by the authority. [Sec. 141.032(c)] The petition is NOT considered part of the application for purposes of determining compliance with the requirements applicable to each document; that is, a deficiency in the requirements of one document may not be remedied by the contents of the other document. [Sec. 141.032(c)]

  4. An initial determination that an application complies with the requirements as to form, content, and procedure does NOT preclude a later determination that the application does not comply, subject to Section 141.034. (Section 141.034 sets a deadline for challenges to form, content, or procedure. See IV. A. 6., below.) [Sec. 141.032(d)] 

  5. If an application does not comply with applicable requirements, the authority must reject the application and immediately deliver to the candidate written notice of the reason for the rejection. [Sec. 141.032(e)] 

  6. Application and any accompanying petition is public information as soon as it is filed. [Sec. 141.035] Therefore, any person may request a viewing or a copy.

Drawing. [Sec. 52.094]

  1. A drawing must be held to determine ballot order.

    1. Deadline. There is no deadline; however, the drawing must occur in order to timely finalize ballots for ballot by mail. SOS recommends in our calendars to conduct the drawing after the withdrawal deadline. 

    2. Notice. The District will provide notice to each candidate of the date, hour, and place of the drawing via telephone or email.

Elections

The District is governed by a Board of five members that serve staggered four-year terms. In accordance with Texas Water Code § 49.103, director elections are held on the November uniform election date, or the first Tuesday after the first Monday in November, in even-numbered years.  The District’s next director election will be held on November 5, 2024 at the polling places for each election precinct within the District established by Ector County.

A person that desires to be a candidate in the District’s next director election must be qualified to serve as a director and must timely submit an application for a place on the ballot to the District. To be qualified to serve as a director, a person must be at least 18 years old, a resident citizen of the State of Texas, and either own land subject to taxation in the District or be a qualified voter within the District. The first day and time that a candidate may file an application for a place on the ballot is 8:00 a.m. on the day that is 108 days before the election and the last day that a candidate may file an application for a place on the ballot is 5:00 p.m. on the day that is 78 days before the date of the election. The deadline for a declared write-in candidate to file an application is 74 days before the date of the election. Notice and Application.

El Distrito está gobernado por una Junta de cinco miembros quienes sirven mandatos escalonados de cuatro años. De conformidad a la Sección 49.103 del Código de Agua de Texas, las elecciones de directores se llevan a cabo en la fecha uniforme de la elección de noviembre, o el primer martes de noviembre después del primer lunes de noviembre, en los años de números pares. La próxima elección de directores del Distrito se llevará a cabo el 5 de noviembre de 2024 en los lugares de votación para cada precinto electoral dentro del Distrito establecido por el Condado de Ector.

Una persona quien desea ser candidata en la próxima elección de directores del Distrito debe ser calificada para servir como director y debe presentar al Distrito una solicitud oportuna para ser colocada en la boleta. Para ser calificado para servir como director, una persona debe tener por lo menos 18 años de edad, ser ciudadano residente del estado de Texas, y ser dueño de tierra que está sujeto a los impuestos del Distrito o ser un votante calificado para votar dentro del Distrito. El primer día y horario en que un candidato puede solicitar ser colocado en la boleta es a las 8 de la mañana en el día que es 108 días antes de la elección y el último día en que un candidato puede solicitar ser colocado en la boleta es a las 5 de la tarde en el día que es 78 días antes de la fecha de la elección. La fecha límite para presentar una declaración de candidatura por escrito es 74 días antes de la fecha de la elección.  Aviso y solicitud.

Filing Deadline for the November 5, 2024, General Election

Notice, the filing period ends August 19, 2024, at 5:00 pm.

Completed application along with a copy of your current voter registration card or a copy of your warranty deed proving ownership of property within the District must be delivered to the District office, 1039 N. Moss Ave., Odessa, TX 79763 by the filing deadline.  Under Order 2024-06-12.2 Adopting Fee For Place On Ballot, you must also pay a filing fee of $375 when filing the application.
